These Terms of Service ("Terms") govern your access to and use of the Exposr Me mobile application ("App") operated by Reck Advisory LLC ("we," "our," or "us"), a limited liability company organized under the laws of the United States. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
You must be at least 13 years of age to use the App. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the App with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.
Exposr Me is a digital footprint and breach monitoring tool that scans email addresses against the Have I Been Pwned (HIBP) breach database and provides privacy risk scores, breach details, and remediation guidance. The App is an informational and alerting tool only. It does not:

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
Feature availability may change over time. We will provide reasonable notice of material changes to subscription features.
Payment is charged to your Apple ID account at confirmation of purchase. All payments are processed exclusively through Apple's in-app purchase system. We do not collect, process, or have access to your payment information.
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your current subscription plan.
You may manage or cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date.
When your subscription expires or is cancelled, you retain all data stored locally on your device but lose access to premium features including automatic daily scans, push notifications, and advanced analytics.
All refund requests must be directed to Apple at reportaproblem.apple.com. We do not process refunds directly, as all transactions are managed by Apple.
We reserve the right to change subscription pricing. Any price changes will be communicated in advance through the App and will apply only to future billing periods, not to the current active period.
You agree to use the App only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:
Violation of these terms may result in immediate termination of your account without notice or refund.
The App, including all content, features, functionality, design, code, trademarks, and trade dress, is owned by Reck Advisory LLC and is protected by United States and international copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial purposes in accordance with these Terms.
You may not copy, modify, distribute, sell, or create derivative works based on the App without our express written permission.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing, we do not warrant that:
Exposr Me is an informational tool. It is not a substitute for comprehensive identity protection, credit monitoring, cybersecurity consulting, or professional security advice.
To the maximum extent permitted by applicable law, in no event shall Reck Advisory LLC, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the App.
Our total aggregate liability for all claims arising out of or relating to these Terms or the App shall not exceed the total amount you have paid to us through in-app purchases in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Reck Advisory LLC and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of another party.
You may delete your account and terminate your use of the App at any time by navigating to Settings > Delete Account. This action is immediate and irreversible.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice, including but not limited to cases where we reasonably believe you have violated these Terms. Upon termination, your right to use the App ceases immediately.
Upon termination of your account, all locally stored data will be deleted. Sections 7 through 10 of these Terms shall survive termination.
The App integrates with third-party services including Firebase (Google LLC), Have I Been Pwned, and Apple StoreKit. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Your continued use of the App after the effective date of any modifications constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and delete your account.
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in the State of New Jersey. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Reck Advisory LLC regarding your use of the App, and supersede all prior agreements, understandings, and communications, whether written or oral.
